BRP pays additional fine in Arctic Cat case

The U.S. District court for the Southern District of Florida ruled that Arctic Cat was entitled to even more damages on top of the $46 million it has already been awarded, according to an article from Bloomberg BNA.

Originally, the jury decided that BRP “would pay a royalty at $102.54 per infringing vehicle, covering nearly 152,000 vehicles. The court then ordered BRP to pay triple damages, because the patent infringement was willful.”

On August 12, the court granted Arctic Cat’s motion for supplemental damages, totaling an extra $1.5 million. The OEMs will have to negotiate a royalty rate for future infringing sales.
